The full text of the Terms of delivery services (hereinafter referred to as the Terms of Delivery) is posted on the Contractors' websites or at the offices (the Contractor referred to as the Delivery Operator, the Operator receiving the parcel from the Client), posted on the website express.delivery. Upon transferring the Parcel to the Delivery Operator, the Client accepts the Terms of Delivery on his own behalf and on behalf of any person interested in the Parcel (including the Sender and the Recipient), as well as acknowledges that the Terms of Delivery have been brought to his attention, explained to him and understood.
The Delivery Operator undertakes to deliver the parcel to the Recipient, and the Client undertakes to pay for the Services rendered via the service express.delivery. The Delivery Operator has the right to attract a sub-contractor (including the Agent), as well as a transport organization.
If the Client pays for the order, not being either the Sender or the Recipient, the sender and the recipient bear subsidiary liability for the payment obligations of the Client. The Client is responsible for fulfilling his obligations to pay for the delivery of the parcel, including those delivered on payment terms by the Sender (if the Sender and the Client are not one person) or the Recipient if the latter refuses to pay for the delivery.
The Delivery Operator accepts for delivery parcels of documentary and non-documentary nature, not prohibited by the legislation of the countries of departure, transit, and destination. Check the list of prohibited parcels on the websites of our Delivery Operators.
The client ensures the readiness of the parcel for shipment, the availability, and accuracy of filling out the documentation. The customer is responsible for the integrity and safety of packages during transportation and storage if the packaging was done on his own. The Delivery Operator may defer performance of the Contract or to refuse its execution, if the client fails to provide required information and/or documentation.
The customer agrees that the Delivery Operator may, but is not obliged to verify compliance of the description of the parcel specified by the Customer in the waybill and accompanying documents, and its actual contents (in terms of quantity, quality, integrity, defects, etc.).
If delivery is not possible, the Delivery Operator is obliged to notify the Client as soon as this becomes known and return the parcel at the direction of the Client in accordance with the established charges.
The Delivery Operator is liable to the Client for non-fulfillment or improper fulfillment of obligations to provide services in the amount established by law and the Terms of Delivery.
The Delivery Operator is obliged to make several attempts to deliver this Shipment in accordance with the stated terms.
The Delivery Operator is not responsible for the delivery or loss of the parcel if the Client specified incomplete or inaccurate information on the quality, quantity, name of the contents of the parcel when filling out the waybill .
The Delivery Operator is not liable for force majeure circumstances.
In case of non-fulfillment or improper fulfillment by the Delivery Operator of the obligations to provide the Services, the Client has the right to submit a written claim to the Delivery Operator with the documents confirming the provision of services within two weeks from the date of dispatch of the parcel.
In the case that the terms of service set out in the waybill contrary to the Terms of the Delivery in effect at the time of acceptance of the parcel by the Delivery Operator or a separate written contract between the Client and the Delivery Operator, it shall be subject to the conditions set forth in the waybill, not inconsistent with the Terms of Delivery and written contract.
